Terms of Service

By accessing or using Smart Nursing Prep (the "Platform"), you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy, which is incorporated by reference. If you do not agree to these Terms, you may not access or use the Platform.

These Terms constitute a legally binding agreement between you and Smart Nursing Prep ("we," "us," or "our"). We reserve the right to update these Terms at any time, and your continued use of the Platform following any updates constitutes your acceptance of the revised Terms.

Smart Nursing Prep provides an online educational platform designed to help nursing students prepare for their examinations and clinical practice. Our services include, but are not limited to:

• Study notes, guides, and articles organized by nursing topics and semesters
• Interactive quizzes and mock examinations (including NCLEX-style questions)
• Course content and structured learning pathways
• Clinical tools such as nursing care plan templates and dosage calculators
• Community features and study resources

We reserve the right to modify, suspend, or discontinue any part of the Platform at any time with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of services.

To access certain features of the Platform, you must create an account. When creating an account, you agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Keep your password confidential and not share your account credentials with any third party
• Accept responsibility for all activities that occur under your account
• Notify us immediately of any unauthorized use of your account

You must be at least 18 years old (or the age of majority in your jurisdiction) to create an account. We reserve the right to suspend or terminate accounts that violate these Terms.

Some features of the Platform require a paid subscription. By subscribing, you agree to pay the applicable fees as described on our pricing page.

• Billing: Subscriptions are billed on a recurring basis (monthly or annually) at the then-current rate. Your subscription will automatically renew unless you cancel it before the renewal date.
• Cancellation: You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period; you will retain access to paid features until then.
• Refunds: We offer a 7-day refund policy for new subscriptions. Refund requests after this period are evaluated on a case-by-case basis.
• Price Changes: We may change subscription prices with 30 days' notice. Continued use after a price change constitutes acceptance of the new pricing.

All payments are processed securely through Stripe. We do not store your payment card information.

All content on the Platform — including but not limited to text, graphics, logos, icons, images, audio, video, quizzes, and course materials — is the exclusive property of Smart Nursing Prep or its content licensors and is protected by applicable copyright, trademark, and intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to access and use the Platform content for your personal, non-commercial educational purposes only. You may not:

• Reproduce, copy, distribute, or publicly display any content without prior written permission
• Create derivative works from Platform content
• Sell, resell, or commercially exploit any portion of the Platform
• Use automated tools (bots, scrapers) to extract content from the Platform

When using Smart Nursing Prep, you agree NOT to:

• Violate any applicable laws or regulations
• Impersonate another person or misrepresent your credentials
• Upload or transmit viruses, malware, or any other malicious code
• Attempt to gain unauthorized access to any part of the Platform or its systems
• Share account credentials or allow multiple users to share a single account
• Use the Platform for cheating, academic dishonesty, or licensing exam fraud
• Harass, threaten, or harm other users or staff
• Post spam, unsolicited advertisements, or promotional materials
• Interfere with or disrupt the integrity or performance of the Platform

Violation of these prohibitions may result in immediate account termination and, where applicable, legal action.

Educational Content Only. The content provided on Smart Nursing Prep is for educational and informational purposes only. It does not constitute medical advice, clinical guidance, or a substitute for professional nursing judgment. Always follow your institution's protocols and consult qualified healthcare professionals for clinical decisions.

No Guarantee of Exam Success. While we strive to provide high-quality study resources, we do not guarantee that use of our Platform will result in passing any nursing examination, including NCLEX.

Platform Availability. The Platform is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the Platform will be uninterrupted, error-free, or free of viruses or other harmful components.

To the fullest extent permitted by law, Smart Nursing Prep and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising out of or related to your use of or inability to use the Platform.

In no event shall our total liability to you for all claims exceed the greater of (a) the amount you paid to us in the twelve (12) months preceding the claim, or (b) USD $100.

We reserve the right to suspend or terminate your account and access to the Platform at our sole discretion, with or without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason.

You may terminate your account at any time by contacting us at [email protected]. Upon termination, your right to use the Platform will immediately cease.

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Smart Nursing Prep is incorporated, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in that jurisdiction.

If any provision of these Terms is found to be unenforceable or invalid, the remaining provisions shall continue to be valid and enforceable to the fullest extent permitted by law.

We may revise these Terms at any time. When we make material changes, we will update the effective date at the top of this page and, where required, notify you via email or a prominent notice on the Platform. Your continued use of the Platform after the effective date of any changes constitutes your agreement to the updated Terms.
